Welcome to Tosnix. These Terms of Service ("Terms") govern your use of Tosnix services, including chat.tosnix.com, the Tosnix VS Code extension, and related services (collectively, the "Services").

By creating an account, accessing, or using the Services, you agree to these Terms. If you do not agree, please do not use Tosnix.

1. Use of Tosnix

You may use Tosnix only in compliance with these Terms and applicable laws.

You are responsible for:

  • Keeping your account credentials secure
  • Providing accurate account information
  • Using the Services only for lawful purposes
  • Ensuring that you have the necessary rights to any code, files, prompts, or other content you provide to Tosnix
  • Reviewing AI-generated output before using it in production or other important situations

You must not use Tosnix to violate laws, infringe intellectual property or privacy rights, distribute malicious software, abuse our infrastructure, bypass usage limits, or interfere with the Services.

2. AI-Generated Content

Tosnix provides access to AI models operated by third-party providers.

AI-generated responses may be inaccurate, incomplete, outdated, or inappropriate. Tosnix does not guarantee that AI-generated content is correct or suitable for your particular purpose.

You are responsible for reviewing and validating AI-generated code, text, or other output before relying on it.

You retain responsibility for how you use AI-generated content and for ensuring that your use complies with applicable laws and third-party terms.

3. Your Content

You retain ownership of the prompts, code, files, and other content that you provide to Tosnix, subject to the rights necessary for us to operate the Services.

For chat.tosnix.com, Tosnix may store your conversations, including prompts and AI-generated responses, to provide conversation history and related functionality.

For the Tosnix VS Code extension, requests may be transmitted to the AI provider selected by you. Tosnix does not intentionally store your prompts, source code, files, or AI-generated responses as conversation history.

You are responsible for ensuring that you have permission to submit any content to Tosnix or the applicable AI provider.

4. Third-Party AI Providers

Tosnix provides access to models and services operated by third parties.

When you use a third-party AI model, your request may be transmitted to that provider. The provider may have separate terms, privacy policies, and usage restrictions.

Your use of third-party models is also subject to the applicable provider's terms.

Tosnix is not responsible for the availability, accuracy, policies, or behavior of third-party AI services.

5. Accounts and API Keys

Some Tosnix features require an account.

You are responsible for maintaining the security of your account and any API keys or credentials you use with Tosnix.

You must not share your account credentials or API keys with unauthorized users or use another person's account without permission.

We may suspend or terminate accounts that violate these Terms, abuse the Services, or create security or legal risks.

6. Payments and Credits

Certain Tosnix features may require payment or account credits.

Prices, credits, limits, and available models may change from time to time. Applicable charges will be presented before or during purchase.

Payments may be processed by third-party payment providers.

Except where required by applicable law, purchases and used credits may be non-refundable.

If a payment is reversed, disputed, or determined to be fraudulent, we may suspend the associated account or access to paid features.

7. Service Availability

We aim to keep Tosnix available and reliable, but we do not guarantee uninterrupted or error-free operation.

The Services may be temporarily unavailable due to maintenance, updates, infrastructure problems, third-party provider outages, or circumstances beyond our control.

We may modify, suspend, or discontinue any part of the Services at any time.

8. Prohibited Activities

You must not:

  • Use Tosnix for illegal activities
  • Attempt to gain unauthorized access to Tosnix or its infrastructure
  • Circumvent security, rate limits, usage restrictions, or billing mechanisms
  • Abuse or overload the Services
  • Use Tosnix to distribute malware or malicious code
  • Infringe another person's intellectual property or privacy rights
  • Attempt to reverse engineer or compromise the Services except where permitted by applicable law
  • Use automated methods to abuse or excessively consume the Services
  • Resell or redistribute Tosnix access without our permission

We may take appropriate action, including limiting or terminating access, if we believe these rules have been violated.

9. Intellectual Property

Tosnix and its associated software, branding, design, trademarks, and other materials are owned by Tosnix or its licensors.

These Terms do not grant you ownership of Tosnix's intellectual property.

You may not copy, modify, distribute, sell, or create derivative works of Tosnix's proprietary services or branding except as permitted by law or with our permission.

10. Open Source Software

Some Tosnix software may contain or be based on open-source software.

Open-source components remain subject to their respective licenses. Nothing in these Terms is intended to limit rights granted to you under applicable open-source licenses.

12. Disclaimer

TOSNIX DOES NOT GUARANTEE THAT THE SERVICES WILL BE ACCURATE, RELIABLE, SECURE, AVAILABLE, OR ERROR-FREE.

AI-GENERATED CONTENT IS PROVIDED FOR INFORMATIONAL PURPOSES AND SHOULD NOT BE TREATED AS PROFESSIONAL, LEGAL, FINANCIAL, MEDICAL, OR OTHER PROFESSIONAL ADVICE.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TOSNIX AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TOSNIX'S TOTAL LIABILITY ARISING OUT OF OR RELATED TO THE SERVICES WILL BE LIMITED TO THE AMOUNT YOU PAID TO TOSNIX FOR THE SERVICES DURING THE PERIOD SPECIFIED BY APPLICABLE LAW.

Some jurisdictions do not allow certain limitations of liability, so some limitations may not apply to you.

14. Indemnification
